Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Blue Reef AI platform and related services ("Services") provided by Blue Reef AI ("Company," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Acceptance of Terms
By creating an account, connecting integrations, or otherwise using the Blue Reef platform, you represent that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization.
2. Description of Service
Blue Reef AI is an AI-powered sales pipeline management platform that provides deal intelligence, dynamic playbooks, automated call prep, post-call coaching, executive briefings, and pipeline analytics. The platform integrates with third-party services including CRMs, email providers, calendar services, and call recording tools to deliver its functionality.
3. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be authorized by your organization to create an account and connect company data sources. You agree to notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble any part of the platform
- Attempt to gain unauthorized access to other users' accounts or data
- Use the platform to build a competing product or service
- Scrape, crawl, or extract data from the platform by automated means beyond authorized API usage
- Use the platform for any unlawful purpose or in violation of any applicable regulations
- Transmit malicious code, viruses, or any other harmful technology
5. Intellectual Property
Our platform: Blue Reef AI owns all rights, title, and interest in the platform, including its software, AI models, design, and documentation. These Terms do not grant you any ownership rights.
Your data: You retain all rights to data you provide to or generate through the platform. You grant us a limited license to use your data solely to provide and improve the Services.
6. User Data & Privacy
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. Our use of data received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
7. Third-Party Integrations
The platform integrates with third-party services including Google Workspace (Gmail, Calendar), CRMs, and call recording platforms. By connecting these integrations, you authorize Blue Reef AI to access and process data from these services in accordance with our Privacy Policy.
You may revoke access to any integration at any time through your account settings. Third-party services are governed by their own terms and privacy policies. We are not responsible for the practices of third-party service providers.
8. Service Availability
We use commercially reasonable efforts to maintain platform availability. However, we do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our control, including third-party service outages.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE REEF AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO BLUE REEF AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless Blue Reef AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights.
11. Termination
Either party may terminate this agreement at any time. You may cancel your account through your account settings or by contacting support@bluereefai.com.
Upon termination, your data will be available for export for 30 days. After 30 days, all data associated with your account will be permanently deleted in accordance with our Privacy Policy.
12. Modifications to Terms
We may modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on our website and, where appropriate, notifying you by email. Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. You may opt out of arbitration by notifying us in writing within 30 days of accepting these Terms. If arbitration is opted out of or deemed unenforceable, disputes shall be resolved in the state or federal courts located in Delaware.
14. General Provisions
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blue Reef AI regarding the Services.
